Understanding Health & Safety Law for Your Business

Today, we want to share some eye-opening insights from our founder, Karl Spencer at a recent talk at a Large Co-operation Internal Health and Safety Day. During the event Karl had to adapt his planned talk to explain to the professionals in the room Health and Safety Law in the workplace, and how Safety PAL can be your ultimate ally in ensuring compliance and mitigating risks.

The Event’s Eye-Opening Experience

During the event, several speakers showcased innovative health and safety products and procedures designed to enhance workplace safety and efficiency. However, Karl noticed a crucial missing link – the absence of explicit references to the Health and Safety at Work Act 1974 and its relevant regulations enforced by the Health and Safety Executive (HSE). While the products and services presented were impressive, Karl pondered whether they truly met legal requirements and whether those implementing them were fully aligned with necessary Sections and Regulations.

Examples from the other speakers included:

1. Contract manager explained how a video playing on a loop in the canteen supported the Risk Assessment and Method Statement providing a visual aid quickly recognised as the work method.
2. A health and safety representative explained how, through a diligent process, she was able to equip all workers with better respiratory protective equipment.
3. Multiple experts in machinery have shown permitter zoning alarms, preventative measures for pedestrians to ensure an unsafe area and how 3D modelling can prevent how far an excavator slews, lifts and rotates.

Yet, none explicitly referenced adherence to Acts of Parliament or Statutory instruments enforced by the HSE, raising essential questions about compliance. There was no discussion on how their innovations or techniques aligned with the requirements of The Health and Safety at Work Act 1974, its relevant Sections, the Management at Work Regulations 1999, or the numerous HSE publications available from their web portal, with over 100 valuable resources.

Understanding Health and Safety Law

Karl made the decision to adapt his talk based on this observation and decided to emphasise the fundamental basics of workplace health and safety management. He stressed the significance of The Health and Safety at Work Act 1974, which serves as a crucial umbrella legislation, underpinning The Management of Health and Safety at Work Regulations 1999. These regulations impose duties on organizations and employers, making directors personally liable if these duties are breached. In other words, as a director, you have both collective and individual responsibility for health and safety within your company.
